§ 42-87. Suspension or revocation—Grounds; hearing.

  • (a)

    Certificates of public convenience and necessity may be suspended or revoked by the city council at any time where:

    (1)

    The council finds the owner's past record to be unsatisfactory.

    (2)

    The owner fails to operate the taxicab or limousine in accordance with the provisions of this article.

    (3)

    The owner shall cease to operate any taxicab or limousine for a period of 30 consecutive days without having obtained permission for cessation of such operation from the inspector.

    (4)

    The taxicab is operated at a rate of fare other than that provided by this article and stated on the certificate and the rate card issued by the council.

    (5)

    The inspector finds that any agreement of sale, conditional contract of sale or chattel mortgage entered into by the owner is made in fraud of creditors.

    (6)

    The holder of a certificate shall fail to register properly, in the correct and true owner's name, the taxicab or limousine covered by the certificate, with the state, and upon the semimonthly list furnished the inspector of taxicabs or limousines in operation.

    (7)

    The owner allows his taxicab or limousine to deteriorate by failure to maintain it in a safe and dependable condition; to maintain interior and exterior as to cleanliness and appearance acceptable to the inspector.

    (8)

    The owner of a taxicab does not replace his taxicab at the time the model becomes unsafe for public conveyance as determined by the appointed inspector.

    (9)

    The owner of a limousine does not replace his limousine at any time that it becomes unsafe for public conveyance.

    (10)

    For any other reason which, in the opinion of city council, warrants suspension or revocation.

    (b)

    No certificate shall be revoked until 48 hours' notice of hearing shall have been given to the holder of such certificate, and such hearing is duly had thereon.
